The House of Representatives wants an end to pop-up windows where users must give consent for the use of cookies. Thuiswinkel.org supports initiatives that lead to greater ease of use and align with practices in other EU countries.
That various political parties are concerned about cookie walls and pop-ups is evident from an article from nu.nl published today. Meanwhile, VVD, PvdA, and D66 want to make accepting cookies easier. An important condition that all parties set is that the protection of personal data is ensured.
Disruption of customer journey
For webshops, it is important that the customer journey is disrupted as little as possible. "At the same time, it is very valuable for webshops to handle personal data safely. After all, it concerns customers' information," says Martijn Hos from Thuiswinkel.org.
The Consumers' Association has also indicated earlier that the consequences of the cookie law are disruptive for consumers. The Association advocates for a legislative amendment.
Implicit consent where possible
Thuiswinkel.org believes that the Dutch practice and its supervision must align with other European countries. "As long as the consumer is informed clearly and thoroughly, implicit consent should be possible under certain conditions," says Martijn Hos. This consent can then be given by a factual action of a consumer. This can also be done by navigating further within the website without actively responding to the cookie information.
Conditions
A system of implicit consent fits entirely within the original rules. Of course, this comes with conditions. For webshops, it is important that these conditions are not set in stone. They must be elements that contribute to making an informed decision. These may vary depending on the context (what is being sold) and the channel (tablet, smartphone, desktop).
